Special conditions for calculation results

The results here constitute a non-binding recommendation based on manual calculation or calculation with the aid of a software program (such as RITA or FEM (finite element) software used by Röchling), taking into consideration product characteristics and processing information. The recommendation pertains solely to products distributed by Röchling and is not transferable to products of other manufacturers.

The customer is responsible for communicating to Röchling all of the project- and object-related conditions required for the recommendation and for checking whether these match the true circumstances and/or are suitable and permissible for the applications.

Röchling does not check the correctness or completeness of these conditions and circumstances. Reference is expressly made to the fact that a re-evaluation and recalculation may be required if there are even minor discrepancies between the information provided and the true circumstances.

The calculation is generally performed using software according to the functions and calculation methods supported by the software used as well as the technical and legal provisions underlying these. Details of the software used and its underlying calculation methods can be requested from Röchling.

Technical advice is provided free of charge and is generally considered non-binding.

The results of a calculation with the RITA^® software may be conveyed as a summary in the form of a data sheet or in long form as verifiable statics.

The calculation of tanks made from the Polystone^® CubX^® twin-wall sheet with an FEM program does not represent a complete static calculation, but rather solely constitutes a non-binding design proposal with mathematical estimation in relation to technical feasibility and is provided free of charge as guidance.

Röchling employees are not acting as specialist planners, specialist engineers, structural engineers or architects with responsibility. Every static calculation, whether produced using the RITA^® software or an FEM program, solely constitutes a design proposal that is subject to review and approval by appropriate experts.

Reference is expressly made to the fact that, in line with current technical standards, errors in the respective software program used cannot be entirely ruled out. Röchling provides no guarantee and assumes no liability for calculations performed with or without the aid of software.

In all other respects, Röchling, legal agents, employees and vicarious agents of Röchling, irrespective of the legal grounds, are liable only in the event of intent and gross negligence. This does not apply where liability is legally mandated, such as under the German Product Liability Act (Produkthaftungsgesetz), in cases of injury to life, limb or health, or due to the violation of important contractual obligations. Important contractual obligations are those whose fulfilment is necessary to achieve the purpose of the contract. In such cases, Röchling’s liability is limited to foreseeable damage typical of the contract. The preceding provisions do not constitute a change in the burden of proof.
